Muslim girls over THIS age can marry man of her alternative, says High Court


After the age of 16, a Muslim lady can marry an individual of her alternative. The Punjab and Haryana excessive court docket gave an analogous verdict in a case on Monday. Recently, in Pathankot, a 21-year-old man and a 16-year-old lady obtained married on the behest of the household. Justice Jasjit Singh Bedi stated, “The petitioners ({couples}) can’t be disadvantaged of the elemental rights enshrined within the Indian Constitution simply because they’ve married towards the desires of their households.”

Justice Bedi then referred to sharia regulation and stated the wedding of a Muslim lady is ruled by ‘Muslim private regulation’. The choose stated that as per part 195 of Sir Dinshah Fardunji Mollah’s ebook ‘Principles of Mohamedan Law’, a lady above the age of 16 years can marry an individual of her alternative. And because the groom’s age can be greater than 21 years, there can be no impediment on this marriage.
